The Real Estate Contract & Home Selling Documentation
Before you begin negotiating anything and get to the signing of a Real Estate contract, you need to have some real estate forms in place. There are particular forms which should be part of your Private Home Sale kit.
These real estate forms/documents I would recommend you keep in a folder, preferrably a waterproof one which you can slip everything into, to ensure it is all kept neat and tidy. I would also recommend you have spare copies of the real estate sales contract at hand, in case there are any errors made.
The following forms are relative for
Sales Contract - Residential House & Land (Qld)
Sales Contract - Units & Townhouses (Qld)
For contracts for the sale of units and townhouses, I would recommend that you have your lawyer/conveyancer complete them due to the legal complexities involved with the home selling contract, unless you are experienced in completing these forms.
Absolutely Necessary:
a) Warning Statement -
b) Contract for Houses and Land
- pages 1-2 forms the actual contract
- pages 3-7 are the 'Terms of Contract' explaining the contract legalities
- ensure the contract is the latest edition (check with your state real estate body)
Recommended Additional Real Estate Forms (for private sellers):
c) Buyer's Acknowledgement
Buyers Acknowledgement - Houses & Residential Land Sales Contract (Qld)
Buyers Acknowledgement - Unit & Townhouse Sales Contract (Qld)
This form, which is issued by your state Real Estate body, is excellent for private sellers as extra protection against the buyer trying to pull a swifty on the seller.
- It is a real estate document signed by the buyer to acknowledge they have read the warning statement; that the warning statement was attached to the contract when signed, and that they, the Buyer, signed the warning statement before signing the real estate contract.
All of the above real estate forms and documents don't have to be specific Real Estate Body forms, however, for peace of mind it is better if you are using the forms relevant for your state. The reason being, is that buyers feel more comfortable using documents issued by someone they recognise. Buyers will already be wary if it is a private sale, and the more
you can put them at ease, the better it will be for all parties. It is also for your peace of mind as well.

For details of where to get a Real Estate Contract and documents required, it is easiest to contact your lawyer/conveyancer for a copy of these documents. It will be faster and cheaper, because if you purchase them through your state Real Estate body, you will have to buy in bulk at more cost, and you probably won't end up using them, unless you are a seasoned trader.
